How's this for a tough accipiter ID photo — a hawk going into a dive? We have a vote for Coop, and a Sharpie. I am leaning toward Sharpie. How about you? And why?

I am going out on a limb and saying it is definitely NOT an Emperor Penguin.

I’m late to the game, but I’ll chime in. I’m leaning toward Sharp-shinned. I see the hint of a notch in the tail, and the head looks small to me. I’m not considering wing-shape or position here – I assume it’s all masked by the dive. Finally, it just doesn’t look like a Cooper’s to me. 😉 All of that being said, I could easily be wrong.
